Terms of Service

These Terms of Service ("Terms") govern your access to and use of Behexo, an AI-powered lead conversion platform for real estate agents and brokerages. By creating an account or using the Service, you agree to these Terms.

1. Acceptance of terms

By accessing or using Behexo, you confirm that you are at least 18 years old, have legal capacity to enter into these Terms, and agree to comply with all applicable UAE laws and regulations, including those governing real estate, telemarketing, and data protection.

2. Description of the service

Behexo provides:

• AI-powered outbound lead qualification via voice calls
• Real-time AI co-pilot during live client conversations
• AI-generated project pitches and buyer profiles
• A searchable database of UAE real estate projects
• CRM tools for managing leads and client communications
• Integrations with third-party services including Meta, WhatsApp, and Twilio

3. Account registration

You must provide accurate and complete information when creating an account. You are responsible for maintaining the confidentiality of your credentials and for all activity under your account. Notify us immediately at info@behexo.com if you suspect unauthorized access.

4. Subscription and billing

• Plans: Behexo offers Starter, Pro, and Enterprise plans with different feature sets and usage limits.
• Billing: subscriptions renew automatically each month unless cancelled. Annual plans renew annually.
• Usage limits: each plan has specific caps on AI calls, pitches, and live co-pilot usage. Exceeding limits may result in overage charges as disclosed at time of purchase.
• Setup fees: Enterprise (brokerage) plans include a non-refundable one-time setup fee.
• Payment processing: handled by Stripe. By subscribing, you agree to Stripe's terms.
• Failed payments: may result in service suspension after a 7-day grace period.
• Refunds: generally not provided for mid-cycle cancellations. Setup fees are non-refundable once onboarding has commenced.

5. Acceptable use

You agree not to:

• Use Behexo to contact individuals who have not consented to being contacted
• Violate UAE telemarketing or anti-spam regulations
• Upload fraudulent, misleading, or illegal lead data
• Resell, sublicense, or redistribute Behexo without written permission
• Reverse engineer, decompile, or attempt to extract the source code
• Use Behexo to harass, defame, or harm any individual
• Attempt to disrupt, overload, or compromise the Service's infrastructure
• Use Behexo to process data of minors

We reserve the right to suspend or terminate accounts that violate these rules.

6. Your responsibilities as a user

You are solely responsible for:

• Ensuring all leads you import have consented to being contacted
• Complying with UAE real estate regulations including RERA requirements where applicable
• Accuracy of information you provide to Behexo and communicate to your clients
• Any actions taken by your agents or team members using your account
• Securely managing your own Twilio account and associated costs (for Enterprise BYOC customers)

7. Intellectual property

Behexo, including its software, design, branding, and all associated materials, is the property of Behexo and protected by applicable intellectual property laws. You receive a limited, non-exclusive, non-transferable license to use Behexo during the term of your subscription.

You retain ownership of all data, content, and leads you upload. You grant Behexo a license to process this data solely for the purpose of providing the Service.

8. AI-generated content

Behexo generates AI-powered content including call scripts, buyer profiles, and project pitches. This content:

• Is provided "as-is" and should be reviewed by you before client communication
• May contain inaccuracies — you are responsible for verifying any claims about projects, pricing, or financial matters
• Should not be treated as legal, financial, or investment advice

9. Third-party services

Behexo integrates with third-party services including Meta, WhatsApp, Stripe, Twilio, and others. Your use of these integrations is subject to their respective terms. We are not responsible for third-party service outages, policy changes, or actions.

10. Service availability

We strive to maintain high service availability but do not guarantee uninterrupted access. Scheduled maintenance, third-party outages, or unforeseen issues may cause temporary disruptions. Enterprise customers may receive additional uptime commitments as specified in their contract.

11. Limitation of liability

To the maximum extent permitted by UAE law, Behexo shall not be liable for:

• Indirect, incidental, special, or consequential damages
• Lost profits, revenue, or business opportunities
• Losses resulting from AI-generated inaccuracies or third-party service failures
• Any damages exceeding the amount you paid for the Service in the preceding 12 months

12. Indemnification

You agree to indemnify and hold Behexo harmless from claims, damages, or expenses arising from your use of the Service, your violation of these Terms, or your violation of any third-party rights — including claims related to contacting leads without proper consent.

13. Termination

You may cancel your subscription at any time from your account dashboard. Cancellations take effect at the end of the current billing period.

We may suspend or terminate your account for violation of these Terms, fraudulent activity, or failure to pay. Upon termination, your access ends and data is deleted per our Privacy Policy.

14. Changes to the service and terms

We may modify the Service or these Terms at any time. Material changes will be communicated via email or in-app notification. Continued use after changes constitutes acceptance.

15. Governing law and jurisdiction

These Terms are governed by the laws of the United Arab Emirates. Any disputes shall be resolved in the courts of Dubai, UAE.
